Under Massachusetts' Dog Bite Statute and Laws, the owner of a dog that bites a person or causes damages because of an alleged bite or other incident is strictly liable.. This liability can extend to a person who harbors or keeps the dog as well, otherwise known as a "Keeper." There are limited exceptions to the liability imposed by this statute, but defenses do exist nonetheless. Massachusetts laws provide defenses for the dog if the victim engaged in:

• provoking, teasing, torturing or harassing the dog,
• was trespassing or breaking the law when the bite occurred, 
• failed to show proof of the fact that your animal actually bit them, or
• was unreasonably careless around your animal, thus causing their own injury to occur.
